Terms of Service
Article 1 (Purpose)
The purpose of these Terms of Service is to stipulate the conditions of use and overall matters regarding the operation of the services provided by "Mai Passport" (hereinafter referred to as "Mai Passport").
Article 2 (Definitions)
The main terms used in these Terms are defined as follows:
① Member: A person who has agreed to the Terms of the site, provided personal information to register as a member, concluded a user agreement with the site, and uses the site.
② User Agreement: The contract concluded between the site and the member in connection with the use of the site.
③ Member ID (hereinafter "ID"): A unique combination of letters and numbers assigned to each member for member identification and service use.
④ Password: A combination of letters and numbers selected by the member to verify that the member matches the assigned ID and to protect the member's rights and interests.
⑤ Operator: The person who opens and operates the homepage for the service.
⑥ Termination: The act of the member canceling the user agreement.
Article 3 (Rules Outside the Terms)
The operator may announce separate operation policies if necessary. In the event of a conflict between these Terms and the operation policy, the operation policy shall prevail.
Article 4 (Conclusion of User Agreement)
① The user agreement is established when the operator approves the application for registration and the consent to these Terms by the person wishing to use the site as a member.
② A person who wishes to register as a member and use the service indicates their consent to these Terms by reading them and selecting "I Agree" at the time of the site registration application.
Article 5 (Application for Service Use)
① A user who wishes to register as a member and use the site must provide all information requested by the site (User ID, password, nickname, etc.).
② A member who registers false information or steals another person's information cannot claim any rights regarding the use of the site and may be punished according to relevant laws.
Article 6 (Privacy Policy)
The site and the operator do not keep the password among the personal information provided upon member registration, and matters related to this follow the site's Privacy Policy.
The operator makes efforts to protect the member's personal information, including registration information, in accordance with relevant laws.
The protection of the member's personal information shall be governed by relevant laws and the Privacy Policy established by the site.
However, the operator assumes no responsibility for information exposed due to reasons attributable to the member.
If a member registers or distributes illegal content, such as content that harms public morals or national security, the operator may view the member's data and submit it to relevant authorities upon request.
Article 7 (Obligations of the Operator)
① If the operator recognizes that opinions or complaints raised by members are justified, they must be processed as quickly as possible. However, if prompt processing is difficult due to personal circumstances, the operator will do their best by announcing it later or sending a message or email to the member.
② The operator may request the site to repair or restore facilities without delay in the event of equipment failure or loss to provide continuous and stable site operations. However, site operations may be temporarily suspended in the event of natural disasters or unavoidable reasons for the site or operator.
Article 8 (Obligations of the Member)
① Members must comply with matters stipulated in these Terms, all regulations set by the operator, notices, operating policies, and relevant laws. Members must not engage in acts that interfere with the site's business or damage its reputation.
② Unless explicitly agreed by the site, members cannot transfer or gift their right to use the service or their status under the user agreement to others, nor provide it as collateral.
③ Users must take considerable care in managing their ID and password and cannot provide their ID to a third party for use without the consent of the operator or the site.
④ Members must not infringe upon the intellectual property rights of the operator, the site, and third parties.
Article 9 (Service Hours)
① Service hours are generally 24 hours a day, 365 days a year, unless there is a special operational or technical hindrance. However, the site may temporarily suspend the service on dates or times set by the site for regular system maintenance, expansion, and replacement. Temporary suspensions due to scheduled work will be announced in advance on the site's homepage.
② However, the site may temporarily or permanently suspend the service without prior notice in the following cases:
Urgent system inspection, expansion, replacement, breakdown, or malfunction
Force majeure events such as national emergencies, power outages, or natural disasters
When a telecommunications business operator defined in the Telecommunications Business Act suspends telecommunications services
When normal service use is hindered due to a surge in service use
③ In the event of service suspension under the preceding paragraph, the site shall notify members in advance through notices. However, if prior notice is impossible for a service suspension caused by reasons beyond the site's control, it will be replaced with a post-notice.
Article 10 (Termination of Service Use)
① If a member wishes to terminate the user agreement with the site, the member must apply for registration termination online. Separately from terminating the site use, the member must separately terminate the user agreement for the site.
② Upon the termination request, site-related programs provided by the site are automatically deleted from the member management screen, and the operator can no longer view the terminating applicant's information.
Article 11 (Restrictions on Service Use)
Members must not engage in any of the following acts. If such acts occur, the site may restrict the member's service use, take legal action, terminate the user agreement, or suspend the service for a specified period.
① Registering false information when joining or changing information after joining
② Interfering with others' use of the site or stealing information
③ Impersonating the site's management, staff, or related persons
④ Infringing on the personal or intellectual property rights of the site or third parties, or interfering with business
⑤ Fraudulently using another member's ID
⑥ Collecting, storing, or disclosing another member's personal information without consent
⑦ Acts objectively judged to be linked to a crime
⑧ Other acts violating relevant laws
Article 12 (Management of Posts)
① The operator is responsible for the management and operation of the site's posts and materials. The operator must constantly monitor for inappropriate posts and materials, delete them upon discovery or report, and give a warning to the member who registered them. Meanwhile, the member who posts content is responsible for it, and members themselves must not post content that violates these Terms.
② Upon a correction request from a public institution such as the Korea Communications Standards Commission, the operator may delete or move posts without the member's prior consent.
③ The criteria for judging inappropriate posts are as follows:
Content that severely insults or defames another member or a third party
Content that distributes or links to information violating public order and morals
Content that encourages illegal copying or hacking
Advertisements for commercial purposes
Content objectively recognized as linked to a crime
Content that infringes on the copyright or other rights of other users or third parties
Other cases deemed to violate relevant laws
④ If the site or operator receives a request to suspend posting from a third party due to alleged infringement of rights such as defamation or intellectual property rights, they may temporarily suspend the posting (cease transmission). If a lawsuit, settlement, or equivalent decision by a relevant institution is made between the requester and the poster and submitted to the site, it will be followed.
Article 13 (Storage of Posts)
If the site operator is forced to suspend this site due to unavoidable circumstances, they will notify members in advance and make efforts to take all measures to facilitate the transfer of posts.
Article 14 (Copyright of Posts)
① The copyright of the posts posted by a member within the site belongs to the posting member. The site cannot use the posts commercially without the poster's consent. However, this does not apply to non-profit purposes, and the site has the right to publish them within the service.
② Members cannot use the materials posted on the service commercially, such as arbitrarily processing or selling information acquired using the service.
③ If the operator judges that the contents or posts registered by a member fall under any of the items in Article 12, they may delete, move, or refuse registration without prior notice.
Article 15 (Compensation for Damages)
① The member is primarily responsible for all civil and criminal liabilities arising from this site.
② Compensation will not be provided for damages incurred by members from this site if caused by force majeure such as natural disasters, or by the member's intent or negligence.
Article 16 (Indemnification)
① The operator is exempt from liability for any failure by the member to obtain expected profits from the site's service provision or damages arising from the selection or use of service materials.
② The operator is exempt from liability for damages caused by the failure of the site's service infrastructure and telecommunication services provided by other carriers. Damages related to the site's service infrastructure are subject to the site's Terms of Service.
③ The operator assumes no responsibility regarding materials stored, posted, or transmitted by the member.
④ The operator is not responsible for any obstacles to service use caused by reasons attributable to the member.
⑤ The operator is not responsible for any activities (including data transmission and other community activities) between members, or between members and third parties, regardless of whether they occur within or outside this service.
⑥ The operator is not responsible for the authenticity, reliability, accuracy, etc., of the materials posted or transmitted by the member and all materials provided to the member through this site.
⑦ The operator is not responsible for any damages arising from transactions of goods, etc., mediated by the service between members or between members and third parties.
⑧ The operator is not responsible for any disputes occurring between members or between a member and a third party without the operator's attributable negligence.
⑨ The operator is not responsible for member damages caused by system failures occurring without intent or gross negligence during the management, inspection, maintenance, replacement of servers or software operation, system failures due to third-party attacks, the spread of computer viruses for which countermeasures have not been developed by renowned domestic and international research institutes or security companies, or other force majeure events beyond the operator's control.
Addendum
These Terms shall be effective from <Date of Site Establishment>.
